Representative Matters

  • Defended two class action lawsuits brought against Tennessee financial institutions charged with violating the Tennessee Title Pledge Act and the Tennessee Consumer Protection Act.  Successfully argued at the trial court that no private right of action exists under the Title Pledge Act and that class actions are not available under the Tennessee Consumer Protection Act
  • Defended FDCPA class action in the Southern District of New York United States District Court.  Matter was successfully defended so that plaintiff accepted diminimus settlement.  Class was not certified
  • Defended funeral homes in class action brought alleging fraudulent cremations due to subcontractor fraud
  • Coordinating Counsel for Defendants in Multi-District Litigation in pharmaceutical class actions including Baycol, Fen-Phen, Oxycontin, Propulsid, Rezulin, and Vioxx.
