Our Construction Practice Group includes attorneys with professional backgrounds in architecture and city planning.  While our practice involves many areas of the law, the following areas highlight the firm's capabilities:

Litigation and Alternative Dispute Resolution
We have litigation experience in state and federal courts, both at trial and on appeal.  Issues litigated include payment disputes, acceleration, delay claims, construction defects, material failures, labor disputes, contract interpretation, and various other problems that arise in construction projects of all sizes.  We have been involved in cases on industrial plants, jail facilities, parking decks, large industrial boilers, multi-family housing projects, warehouse facilities, and commercial developments.  Alternative dispute resolution (ADR) experience includes mediation and arbitration before the American Arbitration Association as well as a number of private dispute resolution services.  We have resolved, using ADR, such matters as construction claims involving terminations, change orders, differing site conditions, mechanics’/materialmen’s liens, bid issues, and construction/design defects.

Contract Drafting and Negotiation
We have handled negotiations and drafting of construction agreements using standard forms promulgated by the American Institute of Architects, the Associated General Contractors, and forms utilized by federal and state governmental entities.  We have also drafted custom tailored agreements in a wide range of contexts, from agreements for simple residential construction projects to more complex projects.  We have consulted on construction contracts for a wide range of projects including sports stadiums, large industrial plants, health care facilities, commercial projects, public projects and custom homes.

Liens, Bonds, and Other Payment Remedies
We have experience dealing with all aspects of mechanics' and materialmen's liens, including preparing lien notices, prosecuting lien enforcement actions through attachment and/or foreclosure,  protecting owners from lien filings by bonds or other methods, and asserting or defending claims on payment and performance bonds, including Miller Act bonds.  We have handled matters involving Prompt Pay Act claims and claims under various state's trust fund statutes.
