Even Without a Union, Certain Employee Actions Are Still Protected by the National Labor Relations Act

Even though Tennessee is among a group of states with the lowest percentage of union membership (4.7% in 2010), Tennessee employers should not disregard the National Labor Relations Act and the efforts of the activist National Labor Relations Board to broaden and strengthen the Act’s impact on employers. It is critical to recognize that the employee protections in Section 7 of the Act apply to employees of virtually all private-sector employers notwithstanding whether employees are represented by a union.
