Rosemarie Hill, a labor and employment shareholder with Chambliss, recently authored "Take Retaliation Claims Seriously, Or Pay the Price" in the September/October 2012 edition of Insight Into Diversity.
"When an employee who complains of harassment or discrimination is treated poorly afterwards and then complains further of the post-complaint behavior he experienced, he is alleging retaliation. It is that simple and, of course, that complex."
Retaliation lawsuits are increasing at a phenomenal rate and the failure to define or recognize illegal retaliation might explain why. Consult with human resources experts and attorneys; even if you can't prevent a claim, at least you will have built a solid defense should you wind up in court.
