Arbitration & Mediation

Alternative dispute resolution – typically arbitration or mediation – is sometimes the quickest and most cost-effective way to resolve disputes.  Our attorneys have substantial experience both in representing individuals and entities in resolving disputes through arbitration and mediation, and in serving as a neutral arbitrator or mediator.  

Often matters can be resolved before litigation by having the parties agree to mediate or arbitrate the issues.  We frequently provide advice on the alternative dispute process and how it might benefit you. 

Representative Matters

  • Successfully mediated complex dispute involving patent issues: the matter involved both patent and litigation questions, so the services of a patent expert as co-mediator were employed
  • Appointed by U.S. District Court to mediate a case involving allegations of overpayments under Medicaid
  • Represented retail outlet against a manufacturer by successfully defending a breach of royalty contract 
  • Represented a manufacturer in the two-week arbitration of an output vs. requirements contractual matter
  • Mediated disputes between brokers and their customers
  • Served as an arbitrator, and frequently as chair, in numerous broker/customer disputes
  • Chaired a three-person arbitration panel that decided a dispute between a broker/accountant and his employer concerning copyright to and ownership of a lucrative "how to" book
  • Mediated personal injury suits, including one against a trucking company that left a young man a quadriplegic, gaining him a settlement for more than $10M
  • Mediated numerous asbestos cases for the Johns-Manville Settlement Trust
  • Handled breach of contract case between family-owned business and Fortune 500 company
  • Defended a community bank organizer and representatives in securities fraud suit with numerous securities law violations under broker-dealer, registration, and disclosure provisions of state and federal securities statutes
  • Chaired a three-person panel of arbitrators to resolve a dispute between two local well-known developers.
