Bankruptcy & Creditors' Rights

Our attorneys handle business and consumer bankruptcy, including commercial litigation and work out issues, primarily for creditors, both secured and unsecured, and creditors' committees.  We strive to counsel business and banking clients on avoiding bankruptcy-related issues before problems arise.  We are acutely conscious of the need to work with clients to make good business decisions, and we focus on practical as well as legal advice.

When bankruptcies, claims, or lawsuits are filed, we are always prepared to vigorously assert our clients' claims and defend our clients.  Many members of our Bankruptcy Group are litigators.  We have handled numerous cases before state courts in Tennessee and the Southeast and federal courts, including all state courts and federal district and bankruptcy courts.  Although most of this commercial litigation does not involve jury trials, our lawyers are experienced in both jury and non-jury cases.

Our Services Include

  • Representation of unsecured creditors' committees
  • Bankruptcy preference litigation
  • Bankruptcy fraudulent conveyance litigation
  • Bankruptcy plans and proposed uses of collateral or refinancing arrangements
  • Forbearance agreements
  • Foreclosure on both personal property and real property
  • General collection of commercial accounts, including enforcement of personal guaranties
  • Out-of-court work outs
  • Relief from the automatic stay.

Our attorneys also advise and litigate for our clients on issues related to bankruptcy and commercial collection work, including, but not limited to, related tax issues, issues under the Federal Employment Retirement Income Security Act (ERISA), and similar issues.  Often the bankruptcy-related work includes involvement in the purchase or sale of assets or businesses and, in conjunction with a number of lawyers in our Business Section, our Bankruptcy Group assists clients in each of these matters.

Bankruptcy and commercial collection matters often arise outside ordinary business hours, and we are ready to respond at any time. We pride ourselves on being available to assist you on a moment's notice at any time of the day or night.
